Biomatic Terms of Use

1. Who provides the service and what these Terms cover
Biomatic (the "App") is provided by Actogram Ltd, a company registered in England and Wales, company No. 14594952, registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("Actogram", "we", "us"). Contact: services@actogram.ai, +44 7473 968854.
These Terms govern your use of the App and any related services (together, the "Service"). By tapping Continue in the App or by using the Service you agree to these Terms. If you do not agree, do not use the Service.
How we handle your personal data is described in the Privacy Policy. The Privacy Policy is a notice about your data, not a contract term; your consents to data processing are given separately in the App and can be withdrawn at any time.
2. What Biomatic is — and is not
Biomatic is a measurement tool. It reads activity data — and, if you allow it, sleep and heart-rate data — from the Apple Health app and your iPhone's motion sensors, sends it to our server and calculates derived metrics: your chronotype, rhythmotype, the hour-by-hour shape of your day, pace, performance, points, tokens, consistency and best week.
Biomatic is not a medical device, a medical service or a healthcare provider. Its metrics are not a diagnosis, a treatment, a medical opinion or medical advice, and they are not intended to diagnose, treat, cure or prevent any disease or condition. The App is for general wellness and informational purposes only. Do not change any treatment, medication or care plan because of something you see in the App. For health questions, consult a doctor. If you think you have a medical emergency, call your local emergency number.
3. Who can use Biomatic
- You must be at least 18 years old. By using the Service you confirm that you are. People under 18 may not use the Service, even with a parent's or guardian's permission. If we learn that an account belongs to someone under 18, we will close it and delete its data.
- You need an iPhone running a version of iOS that Apple currently supports, an Apple ID, and access to the Apple Health app or the iPhone's motion sensors.
- The App is available in the App Store territories we choose to list it in. Availability may change, and we may restrict it in any country where the law, sanctions or App Store rules require it.
- You must not use the Service if you are on a sanctions list applicable in the United Kingdom, the European Union or the United States.
4. Your account
- You sign in with your Apple ID and choose a nickname. Keep your Apple ID secure; you are responsible for activity under your account.
- Register only one account and do not share it. Accounts created by bots or automated means are not allowed.
- Nicknames must not be offensive, misleading, or impersonate another person or brand; we may change or remove a nickname that breaks this rule.
- You can delete your account at any time in Settings → Data & Privacy → Delete my account. Your data is deleted as described in the Privacy Policy; if you allowed "Help improve our method", the de-identified copies made while it was on are no longer connected to you and are kept.
5. Health data, permissions and consent
- The App works only with your explicit consent to read your step data and send it to our server (the "App Features" consent). You give this consent in the App and can withdraw it at any time in Settings → Manage Consent. If you withdraw it, sending stops, your health data is deleted from our server and the App can no longer calculate your metrics.
- Sleep, heart rate and workouts are covered by a separate, optional consent ("Additional Data"). Without them the App still works from your steps, with less precise metrics.
- You choose in iOS which Health data types the App may read. The App only reads Apple Health data; it never writes to Apple Health.
- Location permission is needed for the App to work properly and to track distance correctly; you may decline it.
- You must not feed knowingly false data into Apple Health, or manipulate your device's sensors, to distort your metrics.
6. Accuracy of metrics
Your metrics are calculated from the data your device provides and depend on how complete that data is. If your history is incomplete — for example, you limited access, your phone or watch was not with you, or a data source was unavailable — the metrics are calculated from the available data and marked as based on partial data. Measurements from Apple Health, Apple Watch and third-party devices are produced by those devices and may contain errors we cannot correct. We do not guarantee that any metric is accurate or suitable for any purpose other than general information.
7. Points and tokens
Points and tokens are virtual units that describe your own activity pattern. They have no monetary value, cannot be bought, sold, transferred or exchanged for money, and may be recalculated if the underlying data or our method changes. Features that compare you with other users (leaderboards, friends, marathons) are not part of this release; if we add them, we will describe them in the App and in the Privacy Policy before they go live.
8. Price; future paid features
The App is currently free. If we introduce paid features or a subscription, they will be offered through Apple's In-App Purchase system, the price and terms will be shown before you buy, and these Terms will be updated with a section on purchases, renewals and cancellations before any charge is made. Nothing in the current version of the App requires payment.
9. Acceptable use
You must not:
- interfere with the Service, its servers or networks, or attempt to gain access to other users' data or to any part of the Service you are not authorised to use;
- reverse-engineer, decompile, scrape or copy the App or our calculation method except where the law expressly allows it;
- use the Service unlawfully, or to harass, abuse or harm others;
- submit feedback or content that is unlawful, infringing, offensive or contains other people's personal data;
- use bots, scripts or automated means to create accounts or interact with the Service;
- resell, sublicense or commercially exploit the Service without our written permission.
We may suspend or close an account that breaches these Terms. Except where the breach is serious or the law prevents it, we will tell you first and give you a chance to respond.
10. Your content and feedback
Content you provide (nickname, feedback text, answers to in-app questions) remains yours. You grant us a non-exclusive, royalty-free, worldwide licence to store and use it to operate and improve the Service, for as long as you have an account and afterwards in de-identified form. You confirm that you have the right to provide it and that it does not break the law or infringe anyone's rights. If you send us suggestions or ideas, we may use them without any obligation to you.
11. Intellectual property
The App, its design, the calculation method, the rhythmotype classification, badges, texts and all other materials are owned by Actogram Ltd or its licensors and are protected by copyright, trade mark and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on an Apple device that you own or control, in accordance with these Terms and the Apple Media Services Terms and Conditions. All other rights are reserved. "Biomatic" and the Biomatic logo are trade names of Actogram Ltd.
12. Our responsibility to you
- We will provide the Service with reasonable care and skill.
- The App is free in this release. We do not promise that it will be uninterrupted, error-free or available at all times, and we may change, suspend or discontinue the Service, or any feature, with reasonable notice where possible; if we discontinue the Service you will be able to request a copy of your data first.
- We are not responsible for losses caused by events outside our reasonable control, by errors in data recorded by Apple Health or third-party devices, or by your breach of these Terms.
- The App is not medical advice (section 2). Decisions about your health, treatment or lifestyle should be made with a qualified professional; we are not responsible for such decisions except where the law says otherwise.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited by law, and nothing affects your statutory rights as a consumer or your rights as a data subject.
- If you are a consumer, our total liability to you for other losses is limited to £100 or, if you have paid for the Service, the amount you paid in the 12 months before the claim, whichever is higher.
13. Apple-specific terms
Because the App is distributed through the Apple App Store, the following terms also apply:
- These Terms are between you and Actogram Ltd only, not Apple. Apple is not responsible for the App or its content.
- Your licence is limited to use of the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including Family Sharing where enabled).
- Actogram Ltd, not Apple, is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- Actogram Ltd, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, claims under consumer protection, privacy or similar laws, and claims relating to the App's use of the HealthKit framework.
- If a third party claims that the App infringes its intellectual property rights, Actogram Ltd, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms (for example, your mobile carrier's terms) when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes to these Terms
We may update these Terms. A new version takes effect with the app release in which it appears; the App shows a notice on first launch after the update, and where the law requires it we will ask you to accept the new Terms before you continue. If you do not agree, stop using the Service and delete your account. Versions are numbered and dated; previous versions are available on request.
15. Governing law and disputes
These Terms are governed by the law of England and Wales. If you live in another country as a consumer, you also benefit from any mandatory consumer protections of that country, and you may bring a claim in the courts of that country. Otherwise, the courts of England and Wales have jurisdiction. If you have a problem, please contact us first at services@actogram.ai — we will try to resolve it within a few business days.
16. General
If any part of these Terms is found invalid, the rest remains in force. Our failure to enforce a right is not a waiver of it. We may transfer our rights and obligations under these Terms to a successor of our business; we will tell you if we do. You may not transfer yours. These Terms are the whole agreement between you and us about the Service; the Privacy Policy and the Consumer Health Data Privacy Policy describe how we handle your data and do not form part of the contract.
